We reserve the right to suspend accounts for any violations.

How to use this service

This page provides information on the types of businesses, products, and industries that can’t use ABKA SARL ’s services. To use ABKA SARL ’s services, you must remain compliant with these rules and restrictions. For more information about why we can’t work with every business, please see this terms about our business limitations.

High risk jurisdictions and persons

Use of ABKA SARL 's services for any dealings, engagement, or sale of goods or services either directly or indirectly with the following are prohibited:

High-risk jurisdictions

Persons located in, resident in, or a citizen of, or products or services originating from jurisdictions that ABKA SARL has determined for various reasons, including legal, contractual, and commercial reasons, to be prohibited, including, Cuba, Iran, North Korea, and Syria, and the Crimea, Donetsk, and Luhansk regions.

High-risk persons

Persons ABKA SARL has determined for various reasons, including legal, contractual, and commercial reasons, to be prohibited, such as those individuals or entities named to a restricted person or party list of, or otherwise restricted by, the United States, United Kingdom, European Union, or United Nations, including the sanctions maintained by the US Office of Foreign Assets Control or the Denied Persons List or Entity List maintained by the US Department of Commerce.

Additionally, it’s prohibited to use ABKA SARL 's products and services to directly or indirectly:

Prohibited services

Export, re-export, sell, or supply accounting services; trust and corporate formation services; management consulting services; architecture services; engineering services; quantum computing services; information technology (IT) consultancy and design services; and IT-support services and cloud-based services for enterprise management software and design and manufacturing software to any person located in Russia. In the European Union and the United Kingdom, it is prohibited to use ABKA SARL ’s products and services, directly or indirectly, to provide credit-rating services, market research and public relations services, advertising services, auditing services, or legal advisory services to any person located in Russia.

Prohibited goods

Deal in any goods prohibited by law for export to or import from Russia (for example, luxury goods, sensitive goods included in the Common High Priority Items List, enterprise management software and design software).

You must not use ABKA SARL ’s services for any illegal activities or for the businesses or product types listed below. The types of businesses listed here are representative of prohibited categories, but this is not an exhaustive list.

Businesses that engage in, encourage, promote, or celebrate unlawful violence toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic
Any other products or services that are in violation of law in the jurisdictions where your business is located or to which your business is targeted

Weapon components such as firing pins, magazines, clips, and firearm conversion kits and any 3D-printed weapons
Improperly marked replicas of modern firearms, including toys
Pepper spray and stun guns
Swords and katanas, unless they are meant as replicas or for the practice of martial arts
Machetes
Disguised knives and knives with opening mechanisms designed for quick deployment of a blade
Pesticides requiring application by a certified professional
Research chemicals
Toxic, flammable, combustible, or radioactive materials
Unmailable goods, per the United States Postal Service

Restricted businesses

Businesses in these categories require additional due diligence by ABKA SARL in order to confirm our ability to support them. When you create your ABKA SARL account, you will be asked to provide additional information (such as proof of relevant licenses or more details about your business model) to confirm your eligibility to use ABKA SARL . Due to card network rules, requirements of financial partners, and our own compliance and legal obligations, if your business falls into one of the categories below, ABKA SARL might not be able to grant approval for your business to use our products. If we do provide approval, note that the approval is specific to each service offer, and it may be modified or revoked by ABKA SARL at any time per the terms of the ABKA SARL Services Agreement.

Note: Individual content creators on approved platforms (for example, connected accounts of an approved ABKA SARL Connect user) and those directly distributing their own content (for example, on their own website) do not require preapproval. However, all content creators must comply with the ABKA SARL Services Agreement and this Prohibited and Restricted Businesses list (which, for example, prohibits the sale of adult content) and are subject to monitoring by ABKA SARL to ensure compliance.

Prohibited uses of ABKA SARL products

Use of ABKA SARL products with false, manipulated, inaccurate, or misleading information regarding your identity, business entity, the nature of the business, and any other information requested by ABKA SARL
- If there are any changes to your personal and business information, you must notify ABKA SARL immediately
Use of ABKA SARL products to facilitate transactions on behalf of another undisclosed merchant or for products or services that weren’t disclosed in the business’s ABKA SARL account application
Use of ABKA SARL principally as a virtual terminal (for example, submitting card transactions by manually inputting card information)
Processing where there is no bona fide good or service sold, or donation accepted; card testing
Evasion of card network chargeback monitoring programs
Cross-border acquiring where the business address of the merchant is outside of the jurisdiction of the acquiring ABKA SARL entity, unless permitted under the card network rules
Sharing cardholder information with another business for payment or cross-sell products or services
Use of ABKA SARL intellectual property without prior written consent from ABKA SARL ; use of the ABKA SARL name or logo including use of ABKA SARL trade or service marks inconsistent with the ABKA SARL Marks Usage Agreement, or in a manner that otherwise harms ABKA SARL or the ABKA SARL brand; any action that implies an untrue endorsement by, or affiliation, with ABKA SARL

Utilisation internationale

Lorsque vous vous inscrivez à ABKA SARL Issuing, vous communiquez à ABKA SARL l'emplacement de votre entreprise, l'adresse physique de vos bénéficiaires effectifs et la juridiction dans laquelle votre entreprise est enregistrée. ABKA SARL exige que l'emplacement physique de votre entreprise, sa juridiction d'enregistrement et l'adresse physique d'au moins un de vos bénéficiaires effectifs correspondent. De plus, vous devez utiliser les cartes d'émission principalement dans la même juridiction.

Utilisation du prêt

Vous ne pouvez pas utiliser ABKA SARL Issuing comme méthode pour accorder du crédit à vos clients en utilisant vos propres fonds, à moins que vous ne disposiez de la licence appropriée pour le faire et que vous ayez reçu le consentement exprès d'ABKA SARL pour utiliser Issuing à cette fin.

Utiliser des cartes d'émission pour acheter des articles ou des services en demande dans le seul but de les revendre à des fins lucratives (par exemple, le scalping au détail)
Utilisation des cartes d'émission à d'autres fins illégitimes

Non-conformité

En tant qu'utilisateur d'ABKA SARL Issuing, vous devez vous conformer à nos directives de conformité américaines (ou consulter les directives spécifiques à l'UE et au Royaume-Uni ) et nos équipes de conformité peuvent vous demander de mettre à jour vos supports marketing ou certains aspects de votre expérience utilisateur. Cela permet de garantir que vous et ABKA SARL continuez à vous conformer aux lois et réglementations fédérales, étatiques ou locales ou nationales équivalentes qui régissent l'utilisation de ces produits financiers. Le non-respect des délais demandés peut entraîner la fermeture de votre compte ABKA SARL.

Inactivité

En cas d’inactivité sur toutes les cartes associées à un compte pendant une période de 12 mois consécutifs, ABKA SARL clôture automatiquement votre compte émetteur.

Type d'intégration

Si vous envisagez de permettre à vos clients d'utiliser ABKA SARL Issuing pour créer des cartes pour les employés ou les sous-traitants de vos clients, vous devez implémenter ABKA SARL Issuing sur Connect (par exemple, si vous êtes une plateforme qui souhaite permettre à vos clients de créer des cartes que leurs employés pourront utiliser pour leurs déplacements professionnels ou leurs dépenses marketing, vous devez créer un compte Connect pour chacun de vos clients). 2. Animaux

Vivant, mort, empaillé et n'importe laquelle de leurs parties.

3. Antiquités

Produits technologiques fabriqués avec 20 ans d'ancienneté. Autres articles fabriqués avec 50 ans d'ancienneté.

4. Art

Toute œuvre et type d’art, peinture ou sculpture qui ne peut être reproduit par l’artiste, dont l’auteur est décédé ou qui a une valeur économique supérieure à 700 £.

Organes, tissus, cellules, bactéries, virus, ADN, ARN, déchets cliniques, fluides corporels tels que : sang, urine, matières fécales, salive, sueur, etc.

Restes humains, cendres, etc.

8. Restrictions internationales

Toute marchandise interdite à l’origine ou à destination.

9. Bijoux

Bijoux, montres, pierres précieuses, métaux précieux, vraies perles, argent, or, etc.

10. Médicaments

Tout type de médicament, quelle que soit sa prescription.

11. Argent

Y compris, mais sans s'y limiter, les chèques, les pièces de monnaie, les billets de banque, l'argent de collection, les cartes de crédit/débit, les cartes à puce (par exemple, carte-cadeau, carte SIM, etc.).

12. Stupéfiants

Substances stupéfiantes et/ou psychotropes, ainsi que tous produits dérivés.

13. Produits périssables

Marchandises qui nécessitent une certaine forme de manipulation et/ou une température, une humidité, une luminosité ou une manipulation spécifique.

14. Plantes

Plantes de toutes espèces, vivantes ou séchées, fleurs, terrariums, etc.

15. Timbres

Tout timbre ou document estampillé émis par un gouvernement ou des organismes officiels connexes. Tabac, alcool, loteries d'État, etc.

16. Tabac

Tous types de tabac, cigarette électronique incluse.

17. Véhicules et pièces de moteur

19. Liquides, aérosols et gels (LAG)
